The reference price range, also known as latitude of price acceptance, denotes one spread measure around the reference price. The width of the latitude of price acceptance depends on the three main factors – acceptable price level, purchase frequency and brand loyalty (Gurumurthy Kalyanaram & Little, 1994). Lichtenstein, Bloch, and Black (1988) found that reference price level and knowledge about prices significantly affect the latitude of acceptance. They suggest that higher reference price leads to wider latitude of acceptance. Consumers with greater knowledge of price distributions of the brands are more likely to observe deviations from their reference prices, thus leading to narrow latitude of price acceptance. Similarly, Rao and Sieben (1992) found that moderately knowledgeable consumers display wider latitude of price acceptance than more knowledgeable consumers.

Prospect theory (Kahneman&Tversky, 1979; Thaler, 1985) shows that consumers react sharply and adversely to perceived losses, and less favourably to perceived gains.  This principle has found many business applications. For example, Barberis, Huang, and Santos (2001) show that investors react more sharply to losses in investment portfolio. There is asymmetric response to perceived fluctuations in wealth.

The asymmetric response has found wide applications in marketing, and particularly in pricing. Natarajan, Gurumurthy Kalyanaram, and Munch (2010) have shown such responses to new product announcements.

China filed a criminal lawsuit against Uighur scholar IlhamTohti charging with separatism, a very serious crime in China.  After two days of trial, the Court in China has upheld the charge and has found against Tohti in lawsuit filed by the State.  And now Tohti faces life imprisonment.  Tohti’s case has received great attention from media, policy makers, human right activists, legal scholars and lay men and women.

Experts provide important inputs in arbitrations and litigations (lawsuits). Their input/counsel gives the fact-finder an objective rendition of the facts and assessment of those facts, and facilitates fair adjudication of the dispute/lawsuit.

Without an appropriate expert litigation (lawsuit) can flounder. In a decision in July 2014, Honorable Judge Laura Taylor Swain dismissed the class-action (Celebrex and Bextra) lawsuit against Pfizer because, “Plaintiffs' failure to proffer admissible loss causation and damages evidence is fatal to plaintiffs' claims" after the defendant admitted "without a damages expert a securities fraud trial can't be tried.”

A lawsuit filed by Earth Rights International in the U.S. District Court against Union Carbide (US) for the Bhopal Gas Tragedy was recently dismissed by Justice John Keenan. I am familiar with John Keenan’s decisions – he is generally inclined to grant motions for summary judgment unless the plaintiff in the lawsuit can show robust evidence of dispute of fact(s). Justice Keenan’s threshold is high. He has been a senior judge since mid-1990s.

Reports on Expert Witness Testimony in Litigation between Two Telecom Companies

Gurumurthy Kalyanaram - Former Dean and former NYIT and UT Dallas professor Gurumurthy Kalyanaram reports on his recent expert witness testimony in a lawsuit filed by a start-up telecom firm against a China-based telecom firm.

The background to the lawsuit is as follows.  A start-up telecom company based in US got a license in 2004 to operate in Liberia. The license was for the entire suite of telecom services.  As part of its launch preparation, the start-up explored a collaborative with a China-based telecom company to supply hardware.  The two telecom companies engaged in substantial conversation, and the both signed a Non-Disclosure Agreement.

On Religious Freedom, Town of Greece v. Galloway Gurumurthy Kalyanaram Lawsuit

Galloway and several other residents filed a lawsuit complaining that his freedom of religious expression was violated by his town, Greece in New York, because the town board regularly began its meetings with a Christian-faith based prayer. The Court ruled in favor of the town holding that town boards may start their meetings with sectarian prayers, and do not have to make undue efforts to represent all the faiths. The Court held that the First Amendment was not violated.   This Court’s ruling is similar to the 1983 holding that Nebraska Legislature's practice of starting its sessions with a prayer, saying the practice was "deeply embedded in the history and tradition of this country." Gurumurthy Kalyanaram, Former NYIT and UT Dallas Professor and Dean Emeritus Reports on Appropriate Accounting Methodology

Professor Paul R. Kutasovic of New York Institute of Technology (NYIT), who was a colleague of Gurumurthy Kalyanaram, is an expert and an active independent consultant on macroeconomic forecasts as well as forecasts for the regional economies.  He has conducted research on methods used to forecast sales tax revenues, regional economic activity and the implications of peak oil for the regional economy. He has also worked on using economic indicators to guide the investment decision process. Whistleblower protection and ant-retaliation provisions have spawned lot of debate, and many lawsuit. This reportdiscusses the recent US Supreme Court decision which addressed whether the scope of the anti-retaliation provision of Sarbanes-Oxley Act of 2002.Specifically, whether Section 806 of the Sarbanes-Oxley Act of 2002 (SOX) (codified at 18 U.S.C. § 1514A) limits protection from retaliation to the employees of public companies, or if it also covers employees of contractors to a public company and if the said contractors can file a lawsuit under the anti-retaliation provisions of SOX.

Here is a report on Collateral Estoppel and Materiality of an earlier finding by Professor Gurumurthy Kalyanaram, formerly of NYIT and UT Dallas.

A long line of decisions by the U.S. Supreme Court, U.S. Court of Appeals (Second Circuit), and New York Court of Appeals, have held that, where a decision-maker makes a finding, the finding is not collateral estoppel in a subsequent proceeding unless the finding was material and decisive to the decision, even if it was raised and litigated, particularly where the decision-maker himself explicitly states that the issue was “immaterial” to his decision, and that if there is any uncertainty at all, collateral estoppel shall not apply.

Dr Gurumurthy Kalyanaram - Director of UT Dallas COHORT MBA Program

Dr Gurumurthy Kalyanaram was the founding-director of the full-time, daytime MBA program, Cohort MBA Program.  In 1995, Dr. Kalyanaram was appointed as the founding-director to conceptualize, design, and develop a new full-time, daytime MBA program.  Till then, UT Dallas offered only evening business programs for working adults.  It was decided that the university should offer a full-time day time MBA program – Cohort MBA program – in the Cohort format.  The goal was to design a high-quality and diverse MBA program in terms of students, faculty, curriculum, training and placement of students.  The Cohort MBA program now stands as a viable program, and UT Dallas is ranked as one of the 50-100 business schools in the country.

Major curricular design was undertaken.  Distinguished speakers series was started.  Scholarship funds were instituted.  The first class of 30 students started the program in 1996.

Dr Kalyanaram designed the curriculum (Innovation, Knowledge Economy), recruited the faculty and students, developed industry relations for placement, managed the budget, and led the Cohort MBA Program to be one of the top MBA programs in the country.

Management Review Editorial on Globalization from Dr. Gurumurthy Kalyanaram

We are delighted to present to you six excellent research articles in this Special Issue, “Globalization of Markets and Work force.”

The article by Ford and Whaley addresses two important elements in work force, particularly in private sector and academe: collegiality and perception of justice. The analyses and recommendations are based on data from US. However, there is an evident level of generalizabiliy. Complementing this work, Srivastava examines specific challenges of job-related anxiety and stress among professionals in Mumbai.  While the work by Ford and Whaley is broader about the global work force, the work by Srivastava is very focused and specific. The findings reported in both the articles are applicable and appropriate.

Dr. Gurumurthy Kalyanaram, Professor, Academic Director of MBA Programs (globally) and Director of Faculty Research (NYIT)

Dr. Gurumurthy Kalyanaram was a tenured professor at NYIT, and served as academic director of MBA programs in New York and globally (including Canada, China and Middle-East).  He also led the research efforts of the faculty as the Faculty Research Director.

Dr. Gurumurthy Kalyanaram is distinguished professor with a long record of academic achievements and honors.  He received his B.E. degree in engineering in 1978 from the University of Madras, India, and his M.B.A. in 1983 from the University of Texas.  He earned his Ph.D from the Massachusetts Institute of Technology in 1989 in the field of Management Science, where he won the prestigious Harold Lobdell award.
